קריאה מרקסיסטית של החוקה האמריקאית

תקציר העבודה:

הצהרת העצמאות בתחילה והחוקה האמריקאית לאחריה נכתבו תחת השפעה רבת משמעות של מספר הוגי דעות בני תקופת ההשכלה כדוגמת ג'ון לוק, ז'אן ז'אק רוסו ואחרים. עובדה זו באה לידי ביטוי בצורה הבולטת ביותר בפראפרזה על אחד מחשובי עקרונותיו של ג'ון לוק המופיעה בהצהרת העצמאות האמריקאית. לוק, בחיבורו "איגרת על הסובלנות" טבע את השילוש: חיים, חופש וקניין כזכויות הטבעיות עליהן מופקדת המדינה, מנסחי הצהרת העצמאות האמריקאית החליפו מצידם את הקניין בחיפוש אחר האושר.
ההנחה כי תפקידה של המדינה הוא שמירה על קניינו של הפרט הופכת כל התערבות מטעמה במעשה הכלכלי לבלתי אפשרית. לשיטתו של לוק גביית מיסים וחקיקה כלכלית אינם בגדר המותר והראוי, שכן אלה מהווים פגיעה בקניינו של הפרט. מנסחי הצהרת העצמאות האמריקאית הושפעו מחד מכתביו של לוק והוגים אחרים ומאידך מהרקע ההיסטורי המיידי אשר הוביל להצהרה.
מלחמתן של המושבות בשלטון האנגלי החלה על רקע מחלוקת בין תושבי המושבות לכתר האנגלי בסוגיות מיסוי, עובדה אשר אף מוזכרת בהצהרה עצמה.
על רקע ההשפעות הפילוסופיות על הצהרת העצמאות והחוקה האמריקאית וכן על רקע מלחמת העצמאות האמריקאית וסיבותיה, קמו היסטוריונים, מן הצד השמאלי של המפה הפוליטית, וטענו כי לנגד עיניהם של מנסחי שני מסמכים אלו עמדו כמטרות העיקריות השמירה על ההגמוניה ועל שליטתם של בעלי ההון על אמצעי הייצור. בעבודתי אנסה לבדוק כמה אמת יש בדעה זו. לצורך בדיקה זו אבחן את כתיבתם של מספר הוגי דעות בני תנועת ההשכלה ובעיקר כאלה אשר ניתן להוכיח כי אכן השפיעו על הנפשות הפועלות במושבות האמריקאיות, אקרא קריאה ביקורתית של שני מסמכי היסוד של המדינה האמריקאית ואשתמש בכתיבה ביקורתית בת זמננו על הנושא.
